Marrying a Russian citizen in Spain: the certificate of capacity to marry and its translation

A couple decided to marry in Valencia: he is Spanish, she is a Russian citizen. The Registro Civil gave them a list including a "certificado de capacidad matrimonial" — a certificate that the foreign partner has no impediment to marriage. Russian authorities do not issue such a certificate as such, and many couples lose months over this item.

What replaces the certificate of capacity

In practice, Spanish registries accept a certificate from the Russian civil registry confirming the absence of a state marriage registration. It is issued by a registry office in Russia and can be requested through the consulate or a representative under a power of attorney. The certificate is apostilled and then translated into Spanish. The registry may additionally ask for a statement of marital status certified by the consul.

If the applicant was previously married, a divorce certificate or the spouse's death certificate is required — also apostilled and translated. The registry checks that the previous marriage ended before the new registration.

How recent the documents must be

Spanish registries usually expect marital status certificates and the birth certificate to be recently issued — often within a few months of opening the expediente. The exact period depends on the registry: get it in writing so you do not have to redo documents.

The case

The client first brought a twenty-year-old birth certificate with an apostille. The registry rejected it: the document was worn and old. We obtained a duplicate birth certificate and a no-marriage certificate through a representative in Russia, had them apostilled, and a traductor jurado translated them. The expediente was opened on the first attempt and the wedding took place in the planned month.

In short: order the civil registry certificates last and as one set, have them translated by a traductor jurado, and check that the Latin spelling of the surname matches the passport — it will be recorded the same way on the Spanish marriage certificate.
