Family reunification in Germany: the "fresh apostille" myth and the real reasons documents are returned

"I was told the apostille has to be fresh, or the embassy won't accept it" — that is what a client told us as she prepared to join her husband in Germany. Her marriage certificate had been apostilled three years earlier for another trip. We checked: the embassy has no such requirement. An apostille does not expire — it certifies a signature and seal that were genuine when the document was issued.

Where the myth comes from

The confusion comes from documents that do have a shelf life: criminal record certificates, certificates of marital status or registration. These go stale, and their apostille "goes stale" with them. In addition, German registry offices (Standesamt) may require a recently issued birth certificate for a wedding. But for family reunification based on an existing marriage, a certificate apostilled long ago is usually fine.

Why documents are actually returned

First, wear. Soviet and early Russian certificates can be frayed, laminated or have illegible stamps. A laminated document cannot be apostilled, and the embassy may refuse it altogether. The solution is a duplicate certificate.

Second, transliteration. If the surname in the translation is spelled differently from the passport, questions are inevitable. The translator must follow the passport rather than transliterate at will.

Third, an incomplete translation. The apostille stamp, notes on the back, signatures — everything must be translated. The embassy compares the translation with the original carefully.

How to put the file together

Check the document itself: is it legible, is it laminated? If it already has an apostille, do not get a new one. German embassies generally accept translations by sworn translators; check the specific requirements on the website of the mission where you apply. And include the A1 German certificate if it is required in your case — without it the file will be returned regardless of translation quality.
